Defendant-Appellant James Everett Dwyer (Appellant) appeals from the judgment, conviction, and sentence for driving under the influence of intoxicating liquor (DUI). On appeal, Appellant contends that the circuit court erred by: (1) failing to apply Hawaii Rules of Penal Procedure Rule 48 (HRPP Rule 48) to his DUI charges, or in the alternative, by failing to establish or enforce a time limit for Disposition; and (2) denying his motion to dismiss on constitutional speedy trial grounds.
